Who you are buying from
The shop at drmcculloch.com/shop is run by David McCulloch (DR McCulloch), an artist trading as a sole trader from Hale Studios, Unit 12, Millmead Road, Tottenham Hale, London N17 9QU, United Kingdom. You can write to me there or at . I am not registered for VAT, so no VAT is charged.
The works
Every work in the shop is an original, made by hand. There is only one of each unless it is described as an edition. Photographs are as close to the work as I can make them, but colours vary from screen to screen and a handmade surface has marks and variations that are part of the work, not faults. Sizes are given in centimetres and are approximate. Each work is signed on the back and comes with a certificate and a QR code for a tailored interactive piece.
Prices and payment
Prices are in pounds sterling. Delivery is charged by weight and shown at checkout before you pay. Payment is taken by Stripe, which handles your card details; I never see them. While you are at checkout the works in your basket are held for you for a short time and released if the payment is not completed.
Some works are sold by enquiry rather than through the basket. For those we agree the price and delivery by e-mail and I send an invoice; these terms apply to those sales too.
Your order
Your order is accepted and a contract between us is made when your payment is confirmed. Stripe e-mails you a receipt. If a work turns out to be unavailable after you have paid (for example, sold elsewhere at the same moment), I will tell you straight away and refund you in full.
Delivery and collection
I deliver to addresses in the United Kingdom. Works are sent by Royal Mail Special Delivery Guaranteed, insured and signed for, normally within two working days of your order. You can also collect your work free of charge from my studio at Hale Studios, Unit 12, Millmead Road, Tottenham Hale, London N17 9QU, at a time we arrange by e-mail. If you are outside the UK, write to me before you buy and I will quote for delivery.
The work is your responsibility once it has been delivered to you or collected. If it arrives damaged, please tell me within 48 hours with a photograph of the work and the packaging, so I can claim from the carrier; this does not affect your legal rights below.
Changing your mind
You have 14 days from the day you receive a work to cancel your order without giving a reason. To cancel, e-mail me within that time. You then have a further 14 days to send the work back to me, well packed and in the condition you received it. You pay for the return postage. I recommend an insured, tracked service, since the work is your responsibility until it reaches me.
I will refund the price of the work and the standard delivery you paid within 14 days of receiving the work back, to the card you paid with. I may reduce the refund if the work has been damaged by handling beyond what was needed to look at it.
The right to cancel does not apply to work made or altered to your own specification, such as a commission or a work framed to your choice.
If something is wrong
As a consumer you have legal rights under the Consumer Rights Act 2015 if a work is faulty or not as described. Nothing in these terms takes those rights away. Please contact me first and I will put it right.
Copyright
Buying a work gives you the physical work. The copyright in it stays with me, so you may not reproduce it (for example, as prints or merchandise) without my written permission. You are welcome to photograph it in your home and share those photographs.
Liability
I am responsible for loss or damage you suffer that is a foreseeable result of my breaking these terms or failing to use reasonable care and skill. I am not responsible for loss or damage that is not foreseeable or for business losses. Nothing here limits my liability where it would be unlawful to do so.
The game
The game AIDA asks you to play is free and has no prizes. When you clear a page you can put a name on the leaderboard. From then on every page you clear in that game goes up under that name by itself. Your place in the all-time rankings counts them all. Whether you do is up to you. Please don't use a name that is offensive or that is someone else's. Don't pretend to be someone you are not. My server times every page, so nobody can make up a time in their browser. Please play the game yourself: using a script or anything else to play for you, or changing what the game sends, is unfair on everyone who plays by hand. I may hide or delete an entry when I think whoever made it broke these rules. I may also clear a leaderboard and start it again. The game itself may change or stop. You can stop playing whenever you like and ask me to delete your name at any time. The privacy notice sets out what the game records when you play and what happens to your name.
Your information
How I use the details you give when you buy or enquire is set out in the privacy notice.
The law
These terms are governed by the law of England and Wales. Either of us can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland you can also bring proceedings in your own courts. I may update these terms from time to time; the terms that apply to your order are the ones shown here when you placed it.
